NEW DELHI: The Supreme Court has constituted a new nine-judge bench to hear petitions regarding the entry of women of all ages into the Sabarimala Temple. Led by Chief Justice Surya Kant, the bench has scheduled the hearing from April 7 to April 22. This follows the lapse of a previous 2019 bench due to the retirement of eight members.
The following six fundamental legal questions will be addressed by the bench during the hearing: Whether a person not belonging to a religious group can challenge its practices through a public interest litigation. The scope and extent of judicial review concerning religious practices under Article 25. The meaning of ‘morality’ under Articles 25 and 26 and whether it includes constitutional morality. The overall scope and ambit of the right to freedom of religion under Article 25. The interplay between individual rights under Article 25 and religious denomination rights under Article 26. Whether a denomination’s rights under Article 26 are subject to other constitutional provisions and the meaning of “Sections of Hindus” in Article 25 (2) (b). (NDTV)
