Thiruvananthapuram: During the election campaign, V.D. Satheesan’s viral social media reel featuring the line “Let the kids modify…” along with his famous ‘Pookki’ smile struck a chord with Gen Z voters. Following a massive mandate that brought the UDF to power with a thumping majority, the newly formed V.D. Satheesan government is now moving swiftly to fulfill its promise. The Motor Vehicles Department (MVD) is planning to grant permission for 18 specific types of vehicle modifications, sending a wave of excitement through automobile enthusiasts.

According to the MVD, the proposed relaxations will cover around 18 categories, including the installation of stickers and custom lights. However, a final decision will be taken only after getting formal clearance from the state government. The draft report specifies that vehicle owners must pay a designated fee and obtain prior permission for changing the body colour. Installing additional speakers, seat covers, floor mats, steering wheel covers, dash cams, reverse cameras, parking sensors, GPS trackers, roof carriers, and even sun films are included in the list of permissible alterations. The Transport Commissioner has already prepared a comprehensive study report regarding this.

Nevertheless, implementing these changes poses a significant legal challenge due to rigid regulations set by the Central Government and the Supreme Court. The ultimate authority to alter vehicle design rules rests with the Center. The Central Motor Vehicles Act, alongside previous orders from the Supreme Court and High Courts, strictly prohibits major modifications. The apex court had earlier ruled that no exemptions can be granted at the cost of road safety and environmental protection. Section 52 of the Motor Vehicles Act, 1988, clearly mandates that no structural alteration is allowed beyond the specifications provided by the original vehicle manufacturers.

A landmark judgement was passed by the Supreme Court in 2019, which set aside a Kerala High Court Division Bench order that had previously allowed modifications based on state rules. Legal experts are now questioning how the state government can bypass Section 52 of the Central Act to implement these relaxations. Experts from the automobile and insurance sectors also warn that illegal or excessive modifications could lead to the rejection of insurance claims in the event of an accident.

The legal battle dates back to a 2006 circular by the Kerala Transport Commissioner that banned modifications, which was later challenged and stayed by the High Court Division Bench. However, when the MVD appealed against it, the Supreme Court ruled against structural changes. The Amicus Curiae report at the time explicitly stated that the state has no jurisdiction to frame rules that override Section 52 of the Central Motor Vehicles Act, leading to the cancellation of the High Court order. Despite these underlying legal hurdles, the V.D. Satheesan government’s immediate initiative to deliver on its promise to the youth has received widespread praise across social media platforms.
