KOCHI: In a significant development in the 2017 actress assault case, Kerala High Court judge Justice Kauser Edappagath has recused himself from hearing a petition filed by the survivor. With this move, he has become the second high court judge to withdraw from considering the plea within a short span. Earlier, Justice Jobin Sebastian had recused himself from the case citing technical and administrative reasons, after which the matter was redirected to the bench of Justice Kauser Edappagath.
The conflict arises from the fact that during the time when the crucial memory card containing the crime’s visuals was in judicial custody, Justice Kauser Edappagath was serving as the Ernakulam Principal Sessions Judge. The survivor had previously raised allegations that court staff under his supervision had unauthorizedly accessed the card, leading to a change in its hash value. As part of the preliminary inquiry into the data leak, the investigation team had also recorded the statement of Justice Edappagath. Citing moral and professional proprietary under these circumstances, the judge decided to step away from hearing the fresh plea seeking a re-probe.
In her petition, the survivor has requested the High Court to quash the previous inquiry reports submitted by the district judiciary regarding the memory card access. Instead, she has demanded the constitution of a court-supervised Special Investigation Team (SIT), consisting of cyber and digital forensic experts, to conduct a comprehensive and time-bound re-investigation. Following the successive recusals, the petition will now be placed before the Chief Justice to be assigned to another appropriate bench.
