Kerala High Court Freezes State Waqf Board Operations on BJP Leader Shaun George’s PIL.

KOCHI: The Kerala High Court has temporarily frozen the operations of the Kerala Waqf Board. The action comes on a Public Interest Litigation (PIL) filed by BJP State Vice President Adv. Shaun George, among others. The court issued an interim order temporarily freezing all activities of the board.

The court evaluated that the current functioning of the board is not in accordance with Section 40 of the Waqf Act. The order was passed by a bench headed by the Chief Justice. The petitions were filed alleging unconstitutional activities, among other grievances. Until further orders are issued in this case, all proceedings of the Waqf Board must remain suspended.

Following the suspension of the board’s operations, the High Court has handed over temporary charge to the Joint Secretary of the State Waqf Department. The case will be heard again on Wednesday.

The High Court had earlier sought an explanation from the government on a petition filed by ‘ACTS’, a coalition of Christian churches, demanding the dissolution of the Waqf Board, which they alleged was formed illegally by the previous government. Following this, BJP State Vice President Shaun George filed a petition against the non-inclusion of two members from non-Muslim communities in the Kerala Waqf Board.

The petition points out that the current board was formed without complying with the mandatory provision of the 2025 Waqf Amendment Act, which stipulates that the board must have two non-Muslim members, making its present functioning illegal. Shaun’s core argument is that when the government reconstituted the Waqf Board in 2026, all nine members appointed belonged to the Muslim community, which directly violates the amended law.
